PLEASE READ
A GUIDE 2 SKI HIRE is a trading name of SBE UK Limited, having its registered office at 16 Charlotte Square Edinburgh. Wherever used in this site including in these terms and conditions the term A Guide 2 Ski Hire shall mean SBE UK Limited.
The purpose of this website (“the Site”) is to act as an agent between you (“the Client”) and a ski/snowboard equipment hire shop in your chosen resort (“the Shop) for the rental of ski/snowboard equipment the Client from the Shop.
The period of hire is determined by the Client. The price paid by you is as established on the Site or otherwise by agreement between us and you.
You accept that the equipment rented is supplied to you by the Shop and not by A Guide 2 Ski Hire and all liability of whatever sort arising from your rental or use of the equipment hired remains with the Shop. You explicitly accept that A Guide 2 Ski Hire shall have no liability or legal responsibility towards you or any other person using the hired equipment arising from your rental or use of the equipment.
Your use of the site is for the purpose of renting ski/snowboard equipment from a shop in your chosen resort only and for no other purpose, and by your use of the Site you agree to be irrevocably bound by these terms and conditions.
The equipment available is as described on the Site and the Shop agrees to supply you with equipment from the age category (Premium, Value or Low Cost) and where applicable ability level (Pro, Advanced, Intermediate, Beginner, Junior Performance, Junior Sports, Infant) chosen by you.
Reservation Process
You have the option to create your own booking online using our automated system or to use our Ski Hire PA service so that we create your booking for you.
If you create your own booking, we check your information and requirements on receipt of your order. If we think you have ordered unsuitable equipment, we may suggest more suitable equipment for you. No amendments will be made by us to your booking without your agreement.
If you use our Ski Hire PA service we will recommend the most suitable equipment for you and once you have agreed to our recommendations will create your booking online.
In either event once your order has been finalised we will advise you by e-mail that your order has been approved and is awaiting payment.
Payment
No payment is due at the time of placing your order.
After approval of your order, you may pay at any time provided your payment is received no later than 24 hours before collection of the equipment. Full details of your booking and requirements will be passed by us to the Shop immediately on receipt of your payment. You accept that no information on your booking will be transmitted to the Shop until your booking has been paid for in full. We take no responsibility for delays in the issue of your equipment by the shop due to payment not being received from you within the timescales mentioned above.
All payments charged by us are in Euros. At the time of payment your bank may convert your payment into your local currency. We tale no responsibility for the exchange rate used by your bank. Any prices shown on the site in any currency other than Euros are as a guideline only and we accept no liability whatsoever for any changes or errors in exchange rates.
Your Contract
Your order with us becomes a firm booking and a contract is created between you and us at the time you pay for your order. Any amendments made by you to your booking between the time of payment and the time of collection will only come into force as an amendment to the said contract upon payment of any further sum remaining due.
You will receive a formal confirmation of your order along with a booking reference number from us on payment of your order. You must present this document in the resort shop at the time you collect your equipment. You may also be required to present a passport or other photographic identity document and / or provide a credit card security for the safe and timely return of the rented equipment.
Your contract is with AGuide2skihire and not with the individual resort shop. Please note therefore in particular that any requests for refund for any reason must be submitted to us and can not be dealt with by the resort shop.
Equipment Collection and Return
You may collect your equipment from 4pm on the day prior to the first day of use as shown on your order confirmation. You must return the equipment by close of business on the last day of use as shown on your order confirmation.
To collect your equipment you must present a printed copy of your order confirmation. Most shops will require you to give credit card details as a security for the return of the equipment and you may also be asked for proof of identity when you collect your equipment.
If you fail to return your equipment by the due date the resort shop will charge you an additional sum to cover the additional period. AGuide2skhire has no control over this or liability for this.
Should you return your equipment early for any reason whatsoever AGuide2skihire will refund you the appropriate sum for the unused period. Please note that the daily rate tends to decrease as the rental period increases therefore the amount refunded for an early return is usually less than the original cost divided by the original number of days hired for each unused day.
Any request for a refund due to early return should be submitted to AGuide2skihire by e-mail or by post to our current trading address Les Chalets du Cacholet B2, 73150 Val d’Isère, France, within 14 days of the last days hire. There is no admin charge or other fee levied by AGuide2skihire for refunds for any reason.
Use Of Equipment
You undertake that the hired equipment will be used only by the member of your party for whom the booking was originally made and that it will not be sub-let, lent or otherwise used by any third party, with or without consideration.
You alone are responsible fort assessing your ability to safely use the hired equipment.
You undertake that the hired equipment will be used only for the purpose that it was originally hired for and that you will use all reasonable care when using the equipment both in respect to damage to the equipment and in respect to loss or injury to any third party.
You specifically accept that the hired equipment is in good condition when issued to you and must be returned to the resort shop in the same condition. If any piece of equipment bears a code, number or other identifying mark you accept that you must return the identical equipment bearing the same mark to the resort shop.
Equipment Insurance
Most resort shops will offer you additional insurance against the loss, theft, damage or breakage of your rental equipment at a small daily rate. We strongly recommend that you take out this insurance. Insurance of your rental equipment is not included in the hire package rented to you by us.
If you do not accept the insurance offered by a resort shop you will normally be responsible for the full new retail cost of any equipment which is lost, stolen, broken, damaged or otherwise not returned to the shop in the same condition as when you collected it less normal wear and tear. Damage caused by skiing on roads, pavements, car parks etc in particular is not normally considered as normal wear and tear.
If you accept the insurance offered by the resort shop your liability in the event of loss, theft, damage or breakage is normally reduced to a reasonable excess.
Cancellations and Amendments
Your booking may be amended or cancelled by you at any time. Amendments or cancellations prior to the collection of your equipment should be made in writing by e-mail or to our current trading address, Les Chalets Du Cacholet B2, 73150 Val d’Isère. There is no administration charge or other fee for amendments or cancellations and any refund due to you as a result of your cancellation or amendment is made immediately, in full.
If an amendment to your order results in a further payment being due to us, your amendment will not take effect until the full balance had been received by us.
You will receive e-mail confirmation of all cancellations or amendments to your orders.
Any amendments to your requirements during your stay which result in a refund due to you including early return of your equipment for any reason must be dealt with through AGuide2skihire. Your contract is with us and the resort shop will therefore be unable to give you any direct refund. Please advise us within 14 days of your last day’s hire by e-mail or to our current trading address, Les Chalets Du Cacholet B2, 73150 Val d’Isère. We will process your refund directly, there is no administration charge or other fee.
Any amendments to your requirements during your stay which result in a further sum being due by you for your hire (eg upgrade to a superior category or level of equipment) must be dealt with directly between you and the resort shop and any additional sum due should be paid directly to the resort shop.
Language and Jurisdiction
The governing language of these terms and conditions, of the website, of all correspondence between us and you and of the equipment rental contract between us shall be English.
Any disputes relating to the contract between us or otherwise arising out of your use of the site shall be governed by and interpreted by the law of Scotland and SBE UK Ltd and you submit any such disputes to the exclusive jurisdiction of the courts of Scotland.
Should anything contained in these terms and conditions be deemed unenforceable for any reason it shall be excised from these terms and the remaining terms and conditions shall remain in full force and be binding and enforceable.
